Freedom Foundation Sues to Block Oregon Law Silencing Worker Rights Speech 

Union-Backed Law Threatens $1 Billion in Penalties for Telling Public Employees About Constitutional Opt-Out Rights 

 The Freedom Foundation filed a federal lawsuit challenging Oregon House Bill 3789, a law that hands public-sector unions the power to sue the organization into oblivion for doing what it’s done for years: informing public employees about their constitutional rights.

The lawsuit, filed in U.S. District Court for the District of Oregon on December 31, names Oregon Attorney General Dan Rayfield, the Oregon Employment Relations Board, and five major public-sector unions—including SEIU Local 503, Oregon Education Association, and Oregon AFSCME Council 75—as defendants. The Freedom Foundation asked the court to immediately block the law before it took effect January 1, 2026, and to strike it down permanently as unconstitutional.

HB 3789 lets public-sector unions sue the Freedom Foundation for $6,250 per piece of mail sent to workers explaining their right to opt out of union membership under the Supreme Court’s Janus v. AFSCME decision. One mailing to Oregon’s public employees equals approximately $1 billion in potential liability for the Freedom Foundation.

The unions wrote this law. The legislature passed it. The governor signed it. And it targets one organization.

“We’ve helped more than 35,000 Oregon workers exercise their Janus rights over the past seven years,” said Aaron Withe, CEO of the Freedom Foundation. “Those workers have saved—and their unions have lost—over $100 million in dues. Instead of making their case to workers, Oregon’s unions lobbied for a law designed to silence us. We’re not going to let that happen.”

The lawsuit argues HB 3789 violates the First Amendment by discriminating based on content and viewpoint, targeting political speech, forcing speakers to alter their messages, and operating as an unconstitutionally vague threat. The law gives unions the power to bankrupt their most effective critic while leaving unions free to send unlimited recruitment mail to the same workers.

“Oregon already has fraud laws on the books,” said Eric Stahlfeld, the Freedom Foundation’s Chief Litigation Counsel. “This law hands unions the power to bankrupt their most effective critic—the Freedom Foundation—through lawsuits. The First Amendment protects the Foundation’s speech, and we’re confident the court will strike this law down.”

Since the Supreme Court’s 2018 Janus decision struck down forced union dues as unconstitutional, the Freedom Foundation has helped hundreds of thousands of public employees nationwide understand they have a choice about union membership. The organization’s mailings explain how the opt-out process works and what it means financially for workers. If Oregon succeeds in enforcing HB 3789, it could become a model for other blue states across the country.

The Wall Street Journal editorial board weighed in on the controversy, writing that Oregon’s approach raises serious constitutional concerns about government suppression of speech.

“The Supreme Court ruled in 2018 that government can’t force workers to fund unions they don’t support,” said Mark Janus, the Illinois child support specialist whose case led to that landmark decision. “Oregon’s law does exactly what the Court said states can’t do. It lets unions punish anyone who tells workers their constitutional rights exist.”

The Freedom Foundation has already had to change its communications and delay mailings because of HB 3789’s threat. Without a court order blocking the law, the organization faces a choice: stop informing Oregon workers about their rights or risk bankruptcy.

The lawsuit asks the court to declare HB 3789 unconstitutional and block Oregon from enforcing it.

Bill D’Agostino, MRC NewsBusters Senior Research Analyst, exposes how the broadcast networks differ dramatically in reporting the story — with ABC largely avoiding it and NBC only responding after independent reporting went viral.

  • ABC’s World News Tonight spent just 25 seconds on the actual scandal and nearly five times more airtime framing Minnesota’s Somali community as victims.

  • CBS Evening News delivered more than eight minutes of coverage, including three dedicated reports uncovering new details — showing that fair, investigative reporting is still possible within the legacy media.

 The Medford Streetcars

In the summer of 1913, not only did Spencer Bullis organize the Southern Oregon Traction Company (“SOTC”), but the city of Medford gave its approval for it to operate an electric trolley for the public around the city’s streets. SOTC received its first trolley in March 1914 that was a single-truck Birney.

After numerous changes and extensions, the SOTC’s trolley route in Medford by 1925 (when it was removed) extended from the intersection of West Main Street with Elm Street, across Bear Creek, followed East Main Street around Keene Way Drive, and ended at the prestigious Kensington Square.

Bullis wanted expand his line from his Medford route into Jacksonville, then through Phoenix and Talent, and on into Ashland. These routes were never created; however, the existing steam rail-line to Jacksonville was employed.

Established in 1891, the existing Rogue River Valley Railway’s (“RRVR”) tracks connected Medford and Jacksonville and was first used as a short steam line. In January 1916, Bullis had gained its control and electrified the route. He merged the RRVR tracks with his 2-1/2 mile SOTC system as both used standard-gauge track (4-foot, 8-1/2 inches wide).

Prior to Bullis coming in control of the RRVR, William Barnum had been operating the railway. Barnum had introduced public passenger service in 1905 when he put an 8-passenger auto car in use and on the tracks. Four years later, he replaced this with a 28-seat Black Crow that was powered by a gasoline engine and a combination freight and passenger car of his own design. Bullis then added another lighter streetcar and a double-truck car.

Despite the optimism of Bullis and his making a little money from the passenger fares, he went bankrupt in 1916. However, he retained control of the RRVR.

In July 1917, a 26-year-old train engineer, Denver Marsh, was maneuvering his locomotive in pushing two empty cars up the rails along Jackson Creek in a canyon west of Jacksonville. His destination was a log deck about three miles above the town, as Spencer Burris had begun extending the line into the timbered hills. While loading the cars with logs, the workmen yelled for the crew to move the engine backwards so they could load the second one. The fireman removed the blocks that kept the locomotive’s wheels from rolling backwards.

As Marsh slowly moved the engine backwards, the train began to roll back. Setting the airbrake didn’t work, nor did pushing the throttle full-forward. As the train sped backwards out of control, March pushed the fireman out of the cab. The locomotive with its log cars, one completely loaded, raced across a wood trestle that spanned a canyon one mile down from the log camp.

The cars plunged into the canyon, while the locomotive also derailed and crashed into a dirt bank. As Marsh jumped out, the engine followed and crushed his legs as it careened over on its side. The brave engineer died four hours later.

The wrecked train was removed, the line later abandoned, and the tracks and trestle removed. Decades later, volunteers had to hunt to pinpoint the place of the wreck where Denver Marsh had died.

Barnum regained control of the RRVC in 1918 upon its bankruptcy. When he gave up on passenger service in 1920and the wreck could have been a large factor in Bullis’s financial problemsthe trolley era in Southern Oregon had come to a complete end.

Although tiny sections of the old trolley track apparently remain, nearly all were ripped out in 1925. Most of that remainder was later paved overeliminating what was once the evidence of Medford’s and Medford-Jacksonville’s streetcar experiment.

Father-engagement programs from India to Kenya and the Philippines show that when men are welcomed into family life, outcomes for boys and girls improve (6).

 

Peacemakers: Men Who Build and Defend Peace

Recently, in a historic achievement for diplomacy, the Trump Declaration for Enduring Peace and Prosperity, signed by delegations from more than 20 nations, was negotiated entirely by men, underscoring their essential role as peacebuilders (7). In contrast, research by the National Bureau of Economic Research finds that European queens were historically more likely than kings to wage war (8), yet men are often mislabeled as the more violent gender.

 

Builders of Nations

The most recent U.S. labor report reveals that men accounted for over 91% of all workplace fatalities, reflecting their dominant presence in high-risk, essential jobs (9). This pattern holds globally, with recent studies confirming men face significantly higher occupational hazards in industries like construction and protective services (10)(11).
