Ilya Shapiro, senior fellow and director of constitutional studies at the Manhattan Institute, responds to today’s Supreme Court decisions and here’s a summary of his thinking:
West Virginia v. B. P. J., on maintaining biological sex in women’s and men’s sports:
“The Supreme Court got this exactly right. States have enacted biological-sex-based restrictions for the same reason we have female categories of sports in the first place: men and women are biologically different in ways relevant to athletic competition, so it makes sense to separate the sexes. ‘The Equal Protection Clause does not prohibit the States from applying that same principle to all biological males, including those who identify as female,’ Justice Kavanaugh correctly explains. ‘States are not required to conduct an individual-by-individual comparison of the physical and athletic capabilities of all biological males in order to satisfy intermediate scrutiny.’ In other words, the Fourteenth Amendment doesn’t block common-sense distinctions that reflect inherent male advantage in sports. Nor can Title IX, which was enacted to give girls and women the same educational opportunities as boys and men, be read to require inclusion of biological males in female sports categories. The interesting question is whether the Constitution or federal law requires the exclusion of biological males from women’s sports, overriding state laws to the contrary. I think the answer is yes, but that’s left to a future case.”
National Republican Senatorial Committee v. Federal Election Commission, on campaign finance:
“The campaign-finance case was quite possibly the easiest one on the docket, certainly among those that drew broader attention, so it’s no surprise that the Court needed only 29 pages to dispense with it. The bar against party-candidate coordination has always been bizarre and the Supreme Court precedent upholding it, Colorado II, stands out as an aberration in recent First Amendment cases. Rather than scrutinizing the government’s claims, the Court largely deferred to congressional judgment based on its own intuition about the corrupting influence of money in politics. The Court today rightly overrules it because its speculation about the necessity of limits on coordinated party expenditures turned out to be wrong, and its deferential standard of review turned the First Amendment on its head. And of course, as Justice Kavanaugh pointed out, the same rules continue to apply equally to all parties.”
Trump v. Barbara, on birthright citizenship:
“For once I agree with Justice Kavanaugh’s middle-of-the-road approach here, meaning that the Court was wrong on the constitutional question but the executive order conflicts with federal law. Justice Alito actually reinforces that understanding in his dissent when he writes, ‘The Fourteenth Amendment dictates who must be a citizen, but it does not address who may be a citizen by Act of Congress.’ But that statutory route is now foreclosed, leaving the federal government unable to deal with the scourge of birth tourism, which was unknown and inconceivable at the time of the Fourteenth Amendment’s ratification. That’s unfortunate to say the least and—given that the constitutional issue was a close one for originalists—the Court would’ve been better off taking Kavanaugh’s off-ramp and leave the issue to the political branches.”

Big Media Bias issue: While a devastating Father’s Day weekend wave of violence left 36 people shot and seven dead in Chicago, corporate news networks decided the real national emergency was pool algae.
New data from the Media Research Center (MRC) exposes a ridiculous double standard in what the media prioritizes as “news.”
MRC analysts uncovered that broadcast and cable networks dedicated a staggering 579 minutes and 31 seconds—nearly 10 full hours—to tracking the maintenance of the Lincoln Memorial Reflecting Pool. MS NOW led the obsession with an absurd 108 minutes of pool coverage in just three days, while CNN followed with over 264 minutes.
Meanwhile, those same networks completely buried the horrific mass shootings in Chicago. ABC offered the only broadcast network coverage across the entire dial: a single, 16-second mention tucked away in a 4:00 AM news hour. Instead of reporting on severe metropolitan violence, networks filled their airtime with trivial stories about Taylor Swift wedding rumors and a dog watching another dog eat a hot dog

“The judicial branch should ensure federal statutes regarding elections act as a safeguard against states extending the effective period for counting federal ballots. In doing so, the Court enforces congressional legislation that establishes a uniform Federal election day.”
“Today, it has done just the opposite. There is periodic necessity for judicial intervention in election disputes. Unchecked, these Election-day extensions can facilitate procedural errors, malfeasance, and diminished public confidence. This lack of uniformity in federal vote-counting procedure sets a dangerous precedent, one that should be avoided at all costs.”
“This decision is a battle lost both for safe elections, and for the larger defense of the Constitutional principles that the Framers conceived. Election Day means Election Day.”

THE CONSERVATIVES, directed by Nadia Gill, explores the lives and perspectives of conservatives whose views on environmental stewardship and climate issues challenge common political assumptions. The film invites viewers to move beyond stereotypes and encounter a more nuanced picture of people often viewed through a partisan lens.
Both screenings will be followed by facilitated conversations led by Marla Estes, founder of Building Bridgers, an Ashland-based initiative dedicated to helping people navigate political and cultural differences with greater curiosity, understanding, and complexity.
